The Illinois Driver’s License Reinstatement Process
To get your license back after a suspension, the first step is to request an informal hearing with an Illinois Secretary of State (SOS) hearing officer. An informal hearing can be requested for minor traffic violations, a first time DUI, or an incident where there were no fatalities involved. More serious traffic offenses, multiple or felony DUIs, and incidents involving one or more fatalities will require a formal hearing. There are three possible outcomes of your hearing:
- Your license is fully reinstated;
- Your reinstatement request is denied; or
- You are granted a restricted driving permit.
The outcome of the hearing will depend on the circumstances of your case and how well prepared you are to answer the questions asked by the SOS officer. There may be upwards of 100 questions, and if you are not ready to give good answers, the chances of a favorable outcome are reduced.
